For example, partner visa applications from outside the UK, which usually take 12 weeks to process, are currently taking up to 24 weeks to process from the date of biometric enrolment at a visa application centre. However, the Immigration Law Practitioners Association believes that the current delays are “of an entirely different nature”, not least IT problems. UK visa applicants residing in Russia also require TB screening in authorised clinics, and here, too, appointments are severely delayed. The UK government has recently enacted legislation giving it the power to impose visa penalties on applications from nationals of a country that the UK specifies as having taken action that gives rise to a threat to international peace and security. During the passage of the legislation, ministers stated that they intended to use these powers in respect of Russia immediately once the legislation was passed. This has not yet happened, but regardless, there is, in general, no legally enforceable timeframe during which the Home Office is required to process a UK visa application.
Since March 2022, the settlement visa processing time after biometrics from outside the UK has increased to 24 weeks as UKVI is prioritizing Ukraine Scheme. The service standard is to decide a straightforward priority non-settlement entry clearance UK visa application within 5 working days (1-week). Since March 2022, UKVI has suspended priority (non-settlement) visa services for study and work visa applications. However, applicants can still use the priority service for visitor visa applications.
Applicants who apply from within the UK, can stay here until they have been given a decision, so long as they applied before the expiry of their last visa. The Family visa will generally allow you to join certain family members who already live in the UK if you wish to remain in the country for more than 6 months, such as spouses. 4 to 17 years old wishing to study at an independent school should apply for a child student visa. A short-term study visa is suitable for a 6 month stay in the UK to attend a course.
